These terms cover inseeq.com, the inseeq platform and MCP server, and our applications on third-party platforms. Client engagement agreements take precedence where they differ, but never over the rules for platform data.
inseeq works with businesses under individually agreed engagements. These terms set the general frame for using our website, our platform, our MCP server and our applications on third-party platforms; your engagement agreement governs the specifics of our work together.

Where inseeq and a client have signed an engagement agreement, it prevails over these terms where they conflict, except section 5, which always applies. How we handle personal data is set out in our privacy policy.
inseeq is a growth agency. Clients engage us on retainers to plan and run their marketing. The inseeq platform supports that work: each client gets a private organisation with its projects, content and reports, and reporting built on data from the marketing, analytics and CRM accounts the client has connected.
A client may connect an AI assistant of its choice, such as Claude or ChatGPT, to its organisation through the inseeq MCP server. The assistant can read the client's data and work with its projects, tasks and content within the client's portal permissions.
Our connections to advertising platforms are read-only. Neither the portal nor the MCP server changes a client's campaigns. Where a client engages us to manage campaigns, inseeq staff carry out that work on the client's instruction, using the agency access the client grants on the platform itself.
Platform access is personal to the users a client authorises. Keep your credentials and MCP keys confidential; you are responsible for what is done under them. Tell us promptly at legal@inseeq.com if you believe an account or key is compromised and we will disable it.
You confirm that you are authorised to act for the business on whose behalf you use the platform, including when you connect its third-party accounts or an AI assistant.
When you connect an account held with a third-party platform, you authorise inseeq to access it with the permissions shown on that platform's consent screen or in the access you grant, and you confirm that your business holds the rights to the account and may grant this access.
"Platform data" means data inseeq receives from a third-party platform through a connection a client has made, whether viewed in the portal or accessed through a connected AI assistant.

Asking an assistant to do something counts as doing it yourself. We may suspend access, in full or for particular connections, where we reasonably believe this section or a platform's terms are being breached, or where a platform requires it. We will tell the client without undue delay unless we are prevented from doing so.
The platform, its software and design remain ours or our licensors'. Data and content a client brings to the platform, and data from its connected accounts, remain the client's. Rights in work we produce for a client are governed by the engagement agreement.
Personal data is handled as described in our privacy policy. Where we process personal data on a client's behalf, we do so as a processor under Art. 28 GDPR: on the client's documented instructions, under confidentiality, protected by appropriate technical and organisational measures, with notice to the client without undue delay of a personal data breach affecting its data, reasonable assistance with data subject requests, deletion as described in the privacy policy when the engagement ends, and 30 days' notice before a new subprocessor starts processing client data. A data processing agreement formalising this is available on request from legal@inseeq.com. Each party keeps the other's non-public business information confidential and uses it only for the engagement.
We run the platform with reasonable skill and care but do not promise uninterrupted availability. Maintenance and outages of the platforms we depend on can limit it temporarily. We may change the platform as long as the agreed service is not materially reduced.
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and under any guarantee we have expressly given. For simple negligence we are liable only for breach of a material contractual obligation (one whose fulfilment makes proper performance possible and on which the client regularly relies), limited to the damage typical and foreseeable for this kind of contract. Any further liability is excluded.
The client indemnifies us against third-party claims, including by a platform, and reasonable defence costs, to the extent they arise from the client's breach of these terms or misuse of platform data by the client or its users, including through a connected AI assistant. This does not apply where the client is not at fault. We will tell the client promptly about any such claim, not settle it without the client's consent, and let the client take part in the defence.
Platform access runs with the client engagement and ends with it unless agreed otherwise. When it ends we disconnect the client's connections and assistants, revoke and delete stored credentials and delete platform data as described in our privacy policy. Confidentiality and liability provisions continue to apply.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Exclusive place of jurisdiction for disputes with merchants is Berlin.
We update these terms when the service changes; the date at the top reflects the current version. Where a change materially affects a client, we tell the client directly, and it applies to their engagement only as agreed with them.
